Transport/Police/traffic dept gives final reminder
Srinagar, 10 June (KB): Police on friday said that Mandatory Affixation of HSRP to done by 15th June.
Srinagar Police on its official twitter handle as per Kashmir Bulletin — KB said that, High Security Registration Plates: This is Final Reminder by Transport/Police/Traffic departments.
Mandatory Affixation of HSRP to done by 15th June 2022 on all vehicles. Failing this all such Vehicles Without HSRP Shall be Seized & RC may also be recommended for Suspension, reads the police tweet.
Further, Police in a tweet attached a order copy of J&K transport commissioner Bhupinder Kumar, which states that, Whereas, Section 39 of Motor Vehidles Act, 1988 stipulates that no
person shall drive any motor vehicle and no owner of a motor vehicle shall cause or permit the vehicde to be driven in any public place or in any other place unless the vehidle is registered in accordance with Registration of Motor Vehicles under Chapter IV of Motor Vehicle Act and the certificate of registration of the vehicle has not been suspended or cancelled and the vehicle carries a registration mark displayed in the prescribed manner and;
Whereas, Section 41 (6) of Motor Vehicle Act provides that the registering authority shall assign to the vehicle, for display thereon, a distinguishing mark (in the Motor Vehicle Act referred to as the registration mark) consisting of one of the groups of such of those letters and followed by such letters and figures as are allotted to the State by the Central Government from time to time by notification in the Official Gazette, and displayed and shown on the motor vehicle in such form and in such manner as may be prescribed by the Central Government and;
Whereas, Rule 50 of Central Motor Vehicle Rules inter-alla provides following specifications of registration plate:
i. the plate shall be solid unit made of 1.0mm aluminium, rounded and must have an embossed border and the plate is suitable for hot-stamping. the plate should bear the letter “IND” in blue colour on the extreme left center of the plate. each plate shall be protected against counterfeiting by applying chromium-based hologram. the plate shall fastened with non-removable/non-reusable snap lock fitting system and;
ii.. ) Whereas, Section 53(1) (a) of Motor Vehicle Act regarding suspension of registration, prescribes that if any registering
authority or other prescribed authority has reason to believe that any motor vehicle within its jurisdiction
a)is in such a condition that its use in a public place would constitute a danger to the public, or that it fails to comply with the requirements of this Act or of the rules made thereunder and; Whereas, any motor vehicle plying on road in contravention of the provisions of Section 39 of the Motor Vehicles Act, 1988 is liable to be seized and;
Whereas, the Hon’ble Supreme Court of India in Writ Petition titled Maninderjit Singh Bitta Versus Union of India &Ors, held that installation of High Security Registration Plates is a statutory command which is in the interest of security of State and made the scheme of affixation of High Security Registration Plates mandatory for all States.
Whereas, general public has been informed number of times and opportunities were given to the owner of the vehicles in UT of J&K to affix High Security Registration Plates on all motor vehicles vide this office Public Notices No. TC/IK/MVD/5118-21 dated 21-06-2012 repeated on 24-08-2012,22-10-2012,23-01-2013,10-09-2014,17-10-2015 and a timeline of 15th May, 2022 was given in the public notice dated 19-04-2022 and;
Therefore, in view of aforesaid provisions of the Motor Vehides Act, 1988 and rules made thereunder by the Government and directives issued by Hon’bl Security Registration Plates mandatory for all vehicdes, general public is hereby informed through the medium of this notice that non-affixation of High Security Registration Plate on any kind of vehicle shall invoke penalties under Motor Vehicle Act, 1988 including suspension of Registration Certificate and seizure of the motor vehicle w.e.f. 15th June 2022.
Supreme Court making affixation of High General public is further informed to get their vehicles affixed with High Security Registration Plates through concerned RTOs/ARTOS to
avoid action for non-fitment of High Security Registration Plates. Reads the order. (Kashmir Bulletin — KB)
